NOTICE OF PUBLIC CONSULTATION (NO. 1) 2023 

Proposed Making of Local Laws 

1.    Fraser Coast Regional Council ("Council") has proposed to make Community and Environmental Management (Amendment) Local Law (No. 1) 2023 (the "amending local law") and Community and Environmental Management (Amendment) Subordinate Local Law (No. 1) 2023 (the "amending subordinate local law").
2.    The proposed laws amend Local Law No. 3 (Community and Environmental Management) 2011 and Subordinate Local Law No. 3 (Community and Environmental Management) 2011 respectively.

Purpose and General Effect 

3.    The proposed amending local law and amending subordinate local law seek to:
•    avoid duplication with Queensland State legislation by removing designated smoke free areas, prescribed swimming pool standards and noise provisions;
•    add new identified local pests;
•    simplify regulations on the lighting of fires to make it easier to understand;
•    increase penalties for repeat offenders with overgrown or unsightly allotments;
•    increase penalties for shopping centre retailers who repeatedly fail to ensure trolleys remain within their precinct;
•    broaden the definitions of a fire hazard, a community safety hazard, and building appearance to better clarify the intent of the law;
•    make minor administrative and readability amendments as required.

Consultation Period 

4.    Written submissions by any person in support of, or objecting to, the amending local law and subordinate local law are invited commencing on 8 February 2023 and ending on 2 March 2023 (the "consultation period").
5.    During the consultation period Council will make copies of the proposed laws available for inspection and purchase at Council's public offices at 77 Tavistock Street, Torquay or 211-213 Adelaide Street, Maryborough. Alternatively, copies of documentation are available free of charge from Council's website www.frasercoast.gld.gov.au.
6.    Written submissions must be received on or before 2 March 2023 stating-
•    the grounds of the submission; and
•    the facts and circumstances relied on in support of the grounds.
7.    Submissions may be lodged via email at community@frasercoast.qld.gov.au or through Council's online Engagement Hub at www.frasercoast.engagementhub.com.au
8.    Please note that only properly made submissions will be considered. A submission is properly made to the extent that the submission relates only to the proposed amendment. A submission must be made in writing. No acknowledgement will be issued on receipt of submissions.
