NOTICE OF PUBLIC CONSULTATION ON PROPOSED LOCAL LAWS (NO. 8) 2023 

Proposed making of local laws 

1.    Fraser Coast Regional Council ("Council") has proposed to make Animal Management (Amendment) Local Law (No. 1) 2023 (the "amending local law") and Animal Management (Amendment) Subordinate Local Law (No. 1) 2023 (the "amending subordinate local law").
2.    The proposed laws amend Local Law No.2 (Animal Management) 2011 and Subordinate Local Law No.2 (Animal Management) 2011 respectively.

Purpose and general effect 

3.    The proposed amending local law and amending subordinate local law seeks to:
•    Removing mandatory desexing for dogs. This will streamline the registration process with a higher fee still required for an entire dog, but a breeder's permit will no longer be needed;
•    A new animal noise nuisance offence will be introduced with a maximum penalty of $7824 and references added to acceptable noise levels being measured using electronic devices as well as traditionally discretionary methods such as the impact on affected residents; and
•    Simplifying the framework for keeping animals by removing references to urban or rural land to instead impose limits per allotment size with a focus on minimising disruption to neighbours.
4.    The proposed amending local law and amending subordinate local law contain anti-competitive provisions.

Consultation period 

5.    Written submissions by any person in support of, or objecting to, the amending local law and subordinate local law are invited commencing on 30 October 2023 and ending on 21 November 2023 (the "consultation period").
6.    During the consultation period Council will make copies of the proposed laws available for inspection and purchase at Council's public offices at 77 Tavistock Street, Torquay or 211-213 Adelaide Street, Maryborough. Alternatively, copies of documentation are available free of charge from Council's website www.frasercoast.qld.gov.au.
7.    Written submissions must be received on or before 21 November 2023 stating-
•    the grounds of the submission; and
•    the facts and circumstances relied on in support of the grounds.
8.    Submissions may be lodged via email at community@frasercoast.qld.gov.au or through Council's online Engagement Hub at www.frasercoast.engagementhub.com.au
9.    Please note that only properly made submissions will be considered. A submission is properly made to the extent that the submission relates only to the proposed amendment. A submission must be made in writing. No ackriowledgement will be issued on receipt of submissions.
